By using the AmateurDressage.com web site, a service of Amateur Dressage, LLC, you are agreeing to be bound by the following terms and conditions ("Terms of Service").

Acceptable Use and Conduct

You are solely responsible for your conduct and the information you publish or save on the web site.

You also agree not to post, email, transmit, or send via private message, any content or information that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or harms minors in any way
• Harasses, degrades, intimidates, or is hateful toward an individual or group of individuals
• Impersonates an Amateur Dressage employee or user or falsely states or otherwise misrepresents your affiliation with a person or entity
• Includes personal or identifying information about another person without that person's explicit consent
• Is false, deceptive, misleading, deceitful, or constitutes “bait and switch”
• Infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or content that you do not have a right to make available under any law or under contractual or fiduciary relationships
• Creates, sends, or enables anything that constitutes or contains “chain letters,” “pyramid schemes,” or any advertisement that you are prohibited by law from sending
• Constitutes or contains any form of advertising or solicitation if emailed or communicated via the web site directly to registered users
• Advertises any illegal services or the sale of any items the sale of which is prohibited or restricted by applicable law, including without limitation items the sale of which is prohibited or regulated by applicable law
• Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment
• Disrupts the normal flow of dialogue with an excessive number of messages (flooding attack) to the web site, or that otherwise negatively affects other users’ ability to use the web site
• Employs misleading email or IP addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of content and information transmitted through the web site.

Additionally, you agree not to:

• “Stalk” or otherwise harass anyone
• Collect Personal Data about other Users for commercial or unlawful purposes
• Use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from Amateur Dressage -- except for Internet search engines (e.g. Google) and non-commercial public archives (e.g. archive.org)
• Post non-local or otherwise irrelevant content, repeatedly post the same or similar content, or otherwise impose an unreasonable or disproportionately large load on Amateur Dressage web site’s infrastructure
• Attempt to gain unauthorized access to Amateur Dressage's computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Amateur Dressage web site
• Develop, invoke, or utilize any code to disrupt, diminish the quality of, interfere with the performance of, or impair the functionality of the Amateur Dressage web site

Registered User Submission and Conduct

As a registered user on Amateur Dressage you may submit content ("User Submissions").  You understand that whether or not such User Submissions are published, Amateur Dressage does not guarantee any confidentiality with respect to any User Submissions.

You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use the content.

For clarity, you retain all of your ownership rights in your User Submissions. However, by submitting User Submissions to Amateur Dressage, you hereby grant Amateur Dressage a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the Amateur Dressage web site, including without limitation for promoting and redistributing part or all of the Amateur Dressage web site (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Amateur Dressage web site a non-exclusive license to access your User Submissions through the web site, and to use, reproduce, distribute, display and perform such User Submissions as permitted through the functionality of the web site and under these Terms of Service. You understand and agree, however, that Amateur Dressage may retain, but not display, distribute, or perform, server copies of User Submissions that have been removed or deleted.

In connection with User Submissions, you further agree that you will not submit material that is copyrighted, protected by trade secret, or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Amateur Dressage all of the license rights granted herein.

Amateur Dressage does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and Amateur Dressage expressly disclaims any and all liability in connection with User Submissions. Amateur Dressage does not permit copyright infringing activities and infringement of intellectual property rights on its web site, and Amateur Dressage will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights. Amateur Dressage reserves the right to remove Content and User Submissions without prior notice.

Amateur Dressage reserves the right to decide whether content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. Amateur Dressage may remove such User Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.

Warranty Disclaimer

You agree that your use of the Amateur Dressage web site shall be at your sole risk. To the fullest extent permitted by law, Amateur Dressage, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the web site and your use thereof. Amateur Dressage makes no warranties or representations about the accuracy or completeness of this web site’s content or the content of any web sites linked to this site and assumes no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content; (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the web site; (3) any unauthorized access to our use of the site and/or any and all personal information stored therein; (4) any interruption or cessation of transmission to or from our web site; (5) any bugs, viruses, trojan horses, or the like which may be transmitted to our through our web site by any third party; and/or (6) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Amateur Dressage web site. Amateur Dressage does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Amateur Dressage web site or any hyperlinked web site or featured in any banner or other advertising, and Amateur Dressage will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of services or products. As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

Limitation of Liability

In no event shall Amateur Dressage, its officers, directors, employees, or agents be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (1) errors, mistakes, or inaccuracies of content; (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the web site; (3) any unauthorized access to or use of the site and/or any and all personal information stored therein; (4) any interruption or cessation of transmission to or from our web site; (5) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our web site by any third party; and/or (6) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any of any content posted, emailed, transmitted, or otherwise made available via the Amateur Dressage web site, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. You specifically acknowledge that Amateur Dressage shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

The web site is controlled and offered by Amateur Dressage from its facilities in the United States of America. Amateur Dressage makes no representations that the Amateur Dressage web site is appropriate or available for use in other locations. Those who access or use the Amateur Dressage web site from other jurisdictions do so at their own volition and are responsible for compliance with local law.

Indemnity

You agree to defend, indemnify and hold harmless Amateur Dressage, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (1) your use of and access to the Amateur Dressage web site; (2) your violation of any term of these Terms of Service; (3) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (4) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Amateur Dressage web site.

Privacy and Spam

You agree to comply with all applicable laws with respect to

• any collection, use, or disclosure of personal data (as described in the Amateur Dressage Privacy Policy), and
• email communications, including without limitation CAN-SPAM, applicable state laws, and applicable laws in non-U.S. jurisdictions.

You agree to comply with all relevant aspects of the Amateur Dressage Privacy Policy. You agree not to collect or use personal data except as permitted by the Amateur Dressage Privacy Policy. You agree not to harvest any email addresses from the web site for the purpose of sending email in violation of applicable law. You agree not to knowingly collect any information from, or develop any groups on the web site that are targeted at, children under the age of 13.

Content Deletion by Amateur Dressage

Amateur Dressage may delete content without notice or explanation. This right does not transfer automatically to its sponsors, advertisers, registered users, or web site visitors.

Updates to Terms of Service

These Terms of Service may be updated or changed by Amateur Dressage from time to time upon Amateur Dressage’s posting of the amended Terms of Service on this page. If you do not agree to changes to the Terms of Service, you may delete your account and stop using the web site.
